Anyone ever had to fight for unemployment benefits/pay?

Man, Sprint is putting me through some shit.

So as you mostly know i got fired roughly two months ago. the reasoning behind it was both valid and TOTAL BULLSHIT. one of those things where a rule was broken, but its a rule thats broken every day at every store, but my boss, the cunt that he was, and the cunt his friend and boss were, decided to get rid of me to make room for a friend of theirs. ironically this friend stepped down from the promotion a week later because it was too stressful(lol). Anyway. So i filed for unemployment. Sprint came back and denied it. I filed an appeal, Sprint came back and denied it again.

This is where it gets sketchy.

So lets say i was fired for something like sharing my password and login with another employee, thats not exactly it but its close.

Sprint says i admitted to doing this and they committed time fraud with it and i admitted that too. NONE OF THAT IS TRUE. literally none of it. but thats what they said in the denial.

so i did that first appeal, and submitted proof that a superior gave me his codes, and instructed me to give my codes to others to complete certain tasks.(all true supplied screen shots and all).

So when they deny the appeal, they say i used a manager password system to steal passwords and use them to pay myself extra. NONE OF THAT IS TRUE IN ANY WAY SHAPE OR FORM. literally none of it. both denial letters consisted of 100% lies and false information with no proof from them.

So yesterday i had an appeal hearing with a judge in person. Sprint did not show up nor did they call in, so none of the past info, or any evidence from their side of the events are counted and the judgement going forward is 100% based on my testimony and facts.

which is cool. i feel good about it. but i cant help worry that they will attempt to appeal to the circuit appeals court based on their complete lies and misinformation.

I have not had a penny of income in two months, i rightfully under the law deserve this unemployment pay. I had to cash out some 401k savings to make sure the mortgage is paid, thats going to run out soon. 

im so furious and frustrated and broken down from the stress and anxiety. I probably spent $75 and 30-40 hours preparing evidence against them and their lies. Im ready for a fight, but im not sure stress wise i can handle much more fight.

i see why they do this, they probably get out of paying 95% on unemployment claims this way. But im not going to be their bitch TWICE, i was their bitch for money for 10 years, that ended 2 months ago. So i dont know what to expect, i will get a decision by mail "sometime soon" i keep checking online and no statuses have changed.

SECONDLY, I am told that cashing out some 401k will hurt me, a co worker from Sprint got fired and got unemployment, but they saw he cashed out 4 grand of his 401k, so they delayed payments 2 months becasue he had that money. I cashed out all of mine but reinvested some in my wifes IRA and 401k, but i cashed it all out, it was just a heat of fury and said give me all my money fuck the sprint fidelity account. if they hit me with the total amount im not getting paid unemployment for 6 months easy. That would be a LARGE problem.

anyone have an experience or advice?

shit is wearing me down.

If they didn't show up, I find it highly unlikely that they would appeal the decision, as they probably didn't show up because they knew they couldn't win. If they can't win the first time I don't see them coming back. 

The 401k thing is problematic, and I wish I could give you an answer, but I don't know the laws in CO. But look on the bright side: When you do start collecting unemployment, they're going to tax it... :suicide:

i hope the 401k thing slides by or i can get around it. If i can collect unemployment i will be set. we can live on that, and i can continue bettering myself knowledge wise and hopefully re-enter the workforce in a better place for myself and the family. 

rushing back to a low end job with crap pay and crap hours is something i am desperately trying to avoid. 

from the folks i have talked to, this scenario seems to be Sprints MO, they deny deny deny until it becomes an issue of getting someone seriously involved. you know, where it would cost them money to start fighting, at which point its likely cheaper to pay than to fight. so i also dont expect any battles. but until cash hits my bank account, there is a small amount of anxiety left.

Here in Rhode Island unemployment is only concerned with your income for the week ending. I could have a million dollars it doesn't matter. Anything before that is of no concern. Main thing is when you check the box saying " did you earn or receive any income during this period ".We also have justification court. Where you plead your case. In most cases if employer does not appear at hearing .filer usually wins benefits. Them not showing up is weighing towards being in your favor. Good luck

I am curious how it goes, the friend who told me about his 401k and unemployment doesnt speak a ton of english and understand things super thoroughly, so its possibly he is mistaken. i know when i filed it was the 10th, and i couldnt request payment until the 24th-8th, and then payment was dispursed after that timeframe(if i wouldnt have been denied/appealed), not sure how quickly, so its POSSIBLE, he was only delayed one payment period but didnt get any money in hand for 2 months. or close to it.. but i cant really find any rules, laws, regulations, anything..

it APPEARS from the paperwork that what you state is true here, that what you earn that WEEK displaced that amount of pay for that WEEK only. but it doesnt say that, it just asks for that amount for each week, etc.

The best thing going for you is the sprint representative no show. No one should have to go the the shit your going through. I wish you the best.

the process is terrible, and my shit former employer made it even worse. I have been all-consumed with this for weeks, wife and I had a huge fight over everything last night as well. 

IF it goes through and i start getting paid all is well, i know all bills can get paid and all that. Things will be SUPER chill. If not then i have a much closer target to get my shit together...

immense. the couple grand in backpay from the appeal timeframe alone is HUGE. then enough each week to get by without much issue is cool, still have to be frugal but mortgage is paid and food on the table.

Check with your unemployment office. Here in Rhode Island we have a program where you can take an aptitude test .Which allows you to chose from a list of over a thousand free re education & training grants. In my state it's called " network Rhode Island ".You never know it's worth a shot.

I do have a linked in page, i hate linked in. but its necessary for the job hunt, need to get a decent photo up and start network there better.  thank you!

I got my previous job via Robert Half. The key is to work with a recruiter who is concerned with finding a good match, and not just their commission (though you have to make it 6 months or get hired and make it through your trial period before they get the full amount). That's the tricky part....

 robert half doesnt have much in my work zone, my "work zone" is about 10 miles smaller than it will be in 2 years, due to kids getting on bus and off bus at different times and being borderline too young to be home alone, so getting a job that pays 5k more, hell 10k more is wasted on childcare if i work near downtown and the tech opportunities within my area are plentiful but smaller companies, so the job openings are not only few and far between but often filled with referrals vs open job opportunities.

being recently informed that my paid vacation ends at the end of january instead of june, due to the lowest unemployment rates in many years, the extension are cancelled, so i have been whoring like mad.

i made 5 different resumes, one for tech/IT, one for management, one for HR/Payroll, one generic all history one, and one for inventory management.

I currently have a job offer with the USPS as a CCA, basically mail bitch, get a route and same job as regular mail carrier, just 30% lower pay, forced OT, you are bitch to finish everyones work they dont get done, and no benefits. in 3 years i should get the promotion to regular carrier, pay goes from $33k+OT to $45k+OT,  and full benefits, pensions levels at 10 and 20 years. and honestly i could probably retire at 57 when i hit that 20 years.. but, id hate the job, id get by and be fine and could deal with it. but the long hours, crap weather to deal with, missing all my kids sports games, and practices, etc. still be working saturdays, lots of 6 days a week working.. its low on my list.. but is the only actual job offer i got so far.

I have an interview with a Home Builder sub contractor that does framing and siding for large builders, its 6 miles from home, 2.5 miles from my kids schools, its a M-F 8-5 or 9-5 job. no weekends, would be printing blueprints, handling warranty claims with supervisors, running numbers and data for bids and materials buying, etc. pretty easy gig, something new, no customer facing, no retail hassle, and wont miss a second of my kids activities. being off at 5, id be home within 30 minutes of youngest getting home, im ok with my 11 almost 12 yr old being home for 2 hrs, and my 9 yr old can join him for a half hour without much worry, so NO child care costs AT ALL, simple task job, small company, very convenient, the ONLY red flag is no health care, but i am covered with my wifes, so that doesnt effect me at all. 

I have an interview TOMORROW, for a payroll processor specialist for the city i live in, city job, pay is really good, hours the same as small company, be off in time, further from home but a 15 minute drive, nothing serious at all, full benefits, city holidays off, today i would have had a 90 minute delay to start work due to weather, etc. so most times we get thrown a curve ball with cancelled school, id at least have a delay for work which i could get coverage for kids together and still get to work on time. Etc. pay is really solid, better long term option than small company, so they are #1 and #1a in my priorities list.

of course i could get neither. but we will see. could be Cliff Clavin in the end...

My hope, is that they posted jobs for the city, it seemed ALL needed to end on the 30th of Dec, so this job was posted the 28th, so it was up for 2-3 days only, instead of 30, and was in between holiday weeks, so im hoping the job pool of candidates is likely small. however i also have a belief that all god city jobs go to someones cousin or in law or friend, like you need to know someone to get a leg up. but we will see.

kinda strange i got most hits off my Payroll resume. i did a shitload of payroll and HR duties in the last 6 years, so i feel like i have some decent experience, but it all comes down to what software is used. if its peoplesoft i am 100% good to go. if anything else im going to be new to it.

i scheduled my A+ test twice, and got cancelled on twice as i was the only test scheduled that DAY at the test center, so im going to schedule at a new test center further away..

the nice thing also about the 9-5 jobs is i can keep getting certified in the evenings... and a year or two when the kids are more self sufficient, and its time to find a better job ill have a few years experience and a pile of certifications to help me along the way. My friends that I am working for are letting me use them as an IT reference on the resume so if that continues ill have 2+ years of IT/helpdesk type experience, my certs, and a few years away from retail as well.

we will see how it goes.. wish me luck.

ABSOLUTELY wish you all the luck in the world with all of that crap.  What a nightmare with family and all of that going on.  Hope when it all shakes down you end up in a better position with better pay and benefits and all the rest than you had before.

Same goes for anyone else on here (or elsewhere) in the same boat.  That stuff would have to improve to suck.
