What is even crazier is that he would have just gotten misdemeanor if had had sex, instead of a felony for a bj

Recap for the lazy...

17 year old male gets BJ from 15 year old female.
BJ = felony, Intercourse = misdemeanor.
Male offered plea deal where he only serves 2 years, but is a sex offender.
Goes to court, jury conviicts him, without realizing sentence.
17 year old is now 20 years old and serving a 10 year sentence.

Moral of the Story....Dont get a BJ from a white woman in the south ifyou are a black male.

Ben,

Check it out; from CARM:

Song 2:3 "Like an apple tree among the trees of the forest, so is my beloved among the young men. In his shade I took great delight and sat down, and his fruit was sweet to my taste."

Song 4:16, "Awake, O north wind, and come, wind of the south; make my garden breathe out fragrance. Let its spices be wafted abroad. May my beloved come into his garden and eat its choice fruits!”

Notice in Song 2:3 that it says, "...and his fruit was sweet to my taste." Obviously this involves very intimate experience. Tasting one another can have a wide variety of applications. It appears that this is a veiled way of alluding to oral sex. Furthermore, if we look at Song 7:7 we read, “I said, ‘I will climb the palm tree. I will take hold of its fruit stalks.’ Oh, may your breasts be like clusters of the vine." Apparently, fondling of the breasts is meant here. If such enjoyment of the body is intended, and since tasting (which involves the mouth) is part of that expression, it would seem safe to say that oral sex is permissible (by bible standards) between a husband and wife.

I have been holding onto this one for some time.

I'm willing to bet dollars to doughnuts that the Douglas County District Attorney David McDade and the assigned prosecutor Eddie Barker are card carrying members of the KKK. The only reason why this kid is in jail is because of the color of his skin, had this not been an inter-racial relationship this kid wouldn't be in jail wasting tax payers money and taking up space for real criminals who deserved to be locked up.

To me this shows how society is setup to ensnare young black men, if they make the wrong the decision in life there is no mercy for most(expect the ones who offer entertainment value) and they get the harshest penalty allowed by law.

I do not know much about the legal system. But is it possible for the governor to pardon him? The article says the state changed the law after his case and a lot of outcry, but did not make it retroactive.

The article says that the DA and Prosecuter could free him tomorrow if they wanted too, but they want him to admit to being a child molest or "take his medicine" as they phrased it.
Every story needs a villain, and in this one, the villain's hat has been placed squarely on the head of Barker, the prosecutor and a former college baseball player. Barker doesn't write the laws in the books to the left of his desk. He simply punishes those who break them. "We didn't want him to get the 10 years," he says. "We understand there's an element out there scratching their heads, saying, 'How does a kid get 10 years under these facts?' " By element he mean people he would refer to as nigger lovers.

In Barker's eyes, Wilson should have taken the same plea agreement as the others. Maintaining innocence in the face of the crushing wheels of justice is the ultimate act of vanity, he believes.

"I understand what he's saying," Barker says. "I think he's making a bad decision in the long run. Being branded a sex offender is not good; but at the same time, if it made the difference between spending 10 years as opposed to two? Is it worth sitting in prison for eight more years, and you're still gonna be a sex offender when you get out?" What about taking responsibility for enforcing an outdated law that meant to punish pedophiles, not teenagers.

Barker is quick to point out that he offered Wilson a plea after he'd been found guilty -- the first time he has ever done that. Of course, the plea was the same five years he'd offered before the trial -- not taking into account the rape acquittal. Barker thinks five years is fair for receiving oral sex from a schoolmate. None of the other defendants insisted on a jury trial. Wilson did. He rolled the dice, and he lost. The others, he says, "took their medicine." I think Barker is jealous he didn't get the blow job from the 15 year old, 5 years for a blow job, c'mon

While Bernstein works on every possible legal solution, the Douglas County District Attorney's Office has the power to get Wilson out of prison. If the prosecution wanted, this could all end tomorrow. The D.A.'s office says Bernstein hasn't asked. Bernstein says she has. Not that any legal he said/she said matters. Only the prosecutors' opinion does, and according to at least one legal expert, prosecutorial ego is more of a factor in this case than race. The folks in Douglas County are playing god with Genarlow Wilson's life. This shows just how racist the DA and prosecutor are, nothing more than simply southern racism at it's finest, are we living in 2006 or 1956?

"We can set aside his sentence," Barker says. "Legally, it's still possible for us to set aside his sentence and give him a new sentence to a lesser charge. But it's up to us. He has no control over it." Look at the big shot keeping the kid prison because he has the power to do so, what about doing what's right!!!

The position of Barker and the district attorney, McDade, who refused to comment, is that Wilson is guilty under the law and there is no room for mercy, though the facts seem to say they simply chose not to give it to Wilson. At the same time this trial was under way, a local high school teacher, a white female, was found guilty of having a sexual relationship with a student -- a true case of child molestation. The teacher received 90 days. Wilson received 3,650 days.

Now, if Wilson wants a shot at getting out, he must throw himself at the prosecutors' feet and ask for mercy, which he might or might not receive. Joseph Heller would love this. If Wilson would only admit to being a child molester, he could stop receiving the punishment of one. Maybe.

"Well," Barker says, "the one person who can change things at this point is Genarlow. The ball's in his court." What a smug and arrogant prick, to say some devilish shit like that is dispicable. How in the fuck is the ball in Wilson's court and if sed ball was in Wilson's court don't you think he would have freed himself by now? Acting as if Wilson is keeping himself in prison is crazy and shows how prejudice this asshole is!!
It sickening really to think that someone could be so heartless to another human being because of their ego and
ignorance. If America is supposed to be the height of civilized society then I question how civilized we really are? I'm sure Wilson a typical arrogant athlete who had the world kissing his ass because he could run fast and play football, but to send him to jail and label him a child molestor is wrong. Wilson is being punished for a "rape" that didn't happen and for being black in the rural south, the only thing that has changed in the last 75 years is that at least Wilson got to go trial before he was hung up on a tree.

The genuine forgiving yet cynical side of me wants to say that there must be something else this guy did that warranted such a sentence. However, I cannot find any.

Where does it say the girl is white or black? I didn't see it in the article. Are some of you jumpning to a conclusion that isn't there. I am not saying that that could not happen, but is there another story that has the color of her skin listed?

I'm not condoning teenage sex, but that law's messed up. I'm taking a law class right now, and Georgia has some very very messed up laws that need to be fixed. They are literally behind the rest of the country in many areas of law.

there are a ton of stupid laws on the books everywhere, but it is up to the judge/prosecutors to decide whether or not to enforce them.

exceptions from the letter of the law are made in courtrooms every day, with lessened charges, sentences, etc. that a similar course wasn't taken here is more of a reflection of a shitty prosecutor/judge, than a reflection of bad laws. these people should know better. (though i agree with what you're saying...)

a couple of points:

1. this is a RIDICULOUS law.. i mean, how in the fuck can anyone justify this (apparently they didn't considering it was changed after this incident, but still, how did it make the books in the first place?)

2. At first i figured the governor could pardon him, but i was wrong: The governor does not have pardon power in Georgia, but the prosecutor has the power to set aside the verdict. The prosecutor Eddie Barker, apparently waiting for an admission of guilt, has said "the one person who can change things at this point is Genarlow. The ball's in his court." A bipartisan group of legislators have introduced a bill that would free Wilson.[3] - click here

3. When he was a senior in high school, he received oral sex from a 10th grader. He was 17. She was 15. Everyone, including the girl and the prosecution, agreed she initiated the act. But because of an archaic Georgia law, it was a misdemeanor for teenagers less than three years apart to have sexual intercourse, but a felony for the same kids to have oral sex.

though, lets be real: explain how this law hurts black people more than white people... the law isn't racially insensitive... its just stupid... however, the judges and probably the overall culture IS racist and that is the problem here...

4. I call out people or ideas that i think are prejudice towards minorities in this country... but its just as big of a crime imo to assume that this is a racial subject... was the girl even white? seriously, you guys are jumping the gun b/c this doesn't necessarily scream "BBWBBAWB"... That doesn't help anyones arguements...

5. damn that bitch was a slut: Later in the evening, a 17-year-old girl began to have sex with the young men, first in the bathroom, then on the bed. Genarlow is captured on tape appearing to have sex with the girl from behind. Her hand is clearly visible on the floor supporting herself. Witnesses said she was a willing participant.

On tape, the cops saw a 15-year-old girl, a 10th-grader, performing oral sex on a partygoer and, after finishing with him, turning and performing the act on Genarlow. She was the instigator, according to her mother's testimony. Problem was, the girl was a year under the age of consent. Local prosecutors called the act aggravated child molestation, following the letter and not the spirit of the law, which was designed to prosecute pedophiles.

6. However, after all this is said and after hearing the evidence (or lack there of) that was presented in court, and then the judge said "I'm not on trial here, Mr. Wilson," Barker said. "You're the one who did these acts, not me." i think its safe to say that there is some racial problem overall w/ the system and probably particularly this judge...

7. My first impression is that we are missing some of the story like bung said, but after investigating a few sites including wikipdedia, i am convinced that this is one fucked up incident....

If you read the article carefully, the girl that went to the police was 17. The 15 year old girl was just on the video. She never went to the authorities or seemed to want to bring charges. The police just watched the video and took it upon themselves to arrest this kid for getting the BJ.
