When it gets right down to it... it comes down to a he said / she said, especially when the bathroom has been cleaned like it is an operating room... between the prosecutors telling the family that they won't have enough to win a case and Ben offering the family dump truck loads of money to "forget about it" makes it pretty clear why charges didn't move forward.
