Benson sued over dog-bite allegation

Heather Schwartz was at Benson’s home on Oct. 18, 2009, and was “seated and began putting on her shoes” when his dog “without provocation suddenly attacked (her) and began biting her breast,” according to the lawsuit, which was filed Friday in Cook County Circuit Court.

The lawsuit said Schwartz was injured by the bite, but did not offer details of how badly she was hurt.

The dog looked like a Rottweiler, according to the lawsuit.

Schwartz alleges that Benson failed to protect her while she was a guest in his home and knew or should have known that his dog was likely to cause injury. She is seeking an unspecified amount of money. Her attorney could not be reached.

Benson played for the Bears from 2005 to 2007 and since then has been with the . He recently completed a five-day jail term on a misdemeanor assault conviction.

I'm not acting -- being myself. I just see Benson as the type of fool to have a rowdy ass dog that should be put up whenever guests are around,,,that is all.

Someone in your home is considered your responsibility.. If they trip and fall down the stairs because you have a loose board you can be held responsible.. Same thing about a dog, or a hole in your yard that causes someone to break their ankle.

I'm not a lawyer, but I try my best to know the law.

Depends on dog. Statute of limitations in Cook County (where I live & work) is 2 years.
