Attorneys representing jailed Kentucky county clerk Kim Davis have asked an appeals court to force the governor to let her refuse to issue same-sex marriage licenses.

Davis was arrested and imprisoned on Thursday after she refused to grant marriage licenses to same-sex couples, saying it violated her religious beliefs. She's being represented by the Liberty Counsel, a nonprofit legal group that says it advocates for "religious freedom, the sanctity of life and the family."

Liberty Counsel attorney Mat Staver said Monday it has sought emergency relief from the U.S. Court of Appeals for the 6th Circuit, asking the court to require Gov. Steve Beshear, a Democrat, to allow her to continue working as a clerk but refuse same-sex marriage licenses.

"The governor's refusal to take elementary steps to protect religious liberties has now landed Kim Davis in jail," Staver said in a statement. "As a prisoner of her conscience, Davis continues to request a simple accommodation and exemption from the governor."

A federal judge Tuesday ordered the release from jail of a Kentucky clerk who has refused to issue marriage licenses to gay couples, according to a court document. 

U.S. District Judge David Bunning ordered Rowan County Clerk Kim Davis jailed last week after she defied several court orders.

Judge Bunning wrote in the new court order that Davis "shall not interfere in any way, directly or indirectly, with the efforts of her deputy clerks to issue marriage licenses to all legally eligible couples."

If Davis "should interfere in any way with their issuance, that will be considered a violation of this order and appropriate sanctions will be considered," the judge wrote.

Kentucky clerk Kim Davis will return to work next week after having been jailed for contempt of court, and one anti-government group wants to make sure she never winds up behind bars again.  

The Oath Keepers, described by the Southern Poverty Law Center, a civil rights organization, as a “fiercely anti-government, militaristic group,” say they have their sights set on defending the Rowan County clerk, who has refused to issue marriage licenses to same-sex couples.

In a phone call with Jackson County Kentucky Sheriff Denny Peyman, Oath Keepers founder Stewart Rhodes said members of his group had reached out to Davis's legal team and were already forming an on-the-ground presence in Kentucky's Rowan County, but remained tight-lipped on specifics, Right Wing Watch reports. Rhodes said his group's action had nothing to do with same-sex marriage, but instead was focused on his belief that Davis had been illegally detained after being found in contempt of court by not issuing marriage licenses.

 

"As far as we’re concerned, this is not over,” he said in the audio clip above. “This judge needs to be put on notice that his behavior is not going to be accepted, and we’ll be there to stop it and intercede ourselves if we have to." 

Rhodes went on to compare Davis's plight to that of the Founding Fathers, in that it deals "with the magistrates and the officers of the crown who wanted to run roughshod over the rights of the colonists without a jury indictment, without any of that."

The Oath Keepers are trying too hard.

Last time I saw them they were parading around infront of a recruiting station, pretending they were guarding ithe soldiers inside from terrorists. My first reaction was laughter. My second was wondering who was guarding Cliven Bundy's cows now that the Oath Keepers were guarding the army?.

This time they'll probably send a cadre of rednecks and hillbillys to protect a clerk in Kentucky who is in no danger whatsoever, assuming you don't count the periods when Kim Davis is waiting for her order at a drive up window. All because the Oath Keepers know the media likes to film the publics reaction when confronted with groups of men carrying shotguns and semi-automatic rifles into tire shops and mini-marts. All while wearing a home made uniform that would embarrass most mall cops.

Happily, when the Oath Keepers deploy they'll find their weaponized Camaros and Firebirds blend into the local communities far better in Hilltucky than on the open range of Bundy's ranch. And the media should be happy as well as there are plenty of nearby cornfields for CNN journalists to run through should the need arise.

We could be witnessing a perfect storm of stupid, and for once it's not in Texas.
