South Dakota Abortion Ban

The South Dakota Senate has voted 23-12 to pass a total ban on abortion except in the rare case when the life of the mother is in danger.

It is one of the most sweeping abortion bans since the Roe v Wade decision. Sponsor Roger Hunt says it was drafted keeping in mind the legal challenges that will follow in mind.

“It probably will be litigated and probably will find its way through the federal system, likely to the United States Supreme Court.”

The goal is to overturn Roe v Wade. Hunt says the state will defend the bill on two fronts – that technology has advanced so much since abortion was legalized it is no longer assumed that the pre-born baby is not a life, and that the decision doesn’t belong to the federal government in the first place.

“There’s nothing in our United States Constitution that talks about abortion issues which means that that’s a power that’s delegated to the people of South Dakota.”

Kelly Shackelford of the Liberty Legal Institute says among legal scholars, Roe has been on a shaky footing for a while.

“The so called ‘law’ of Roe v Wade is a joke, and anybody that’s honest – legally – understands it is. It’s not in the Constitution, it’s created out of thin air.”

If Roe were to be overturned by this or another lawsuit, states would be left to decide their own abortion laws.

“All it does is it leaves the issue in the hands of the people, and that means that we’re going to have to win the debate.”

In that case, South Dakota has provided a pretty good example. Shackelford agrees that technology puts us in a much better position to argue for protecting life, because the confusion and lies that were foisted on the public in the past can now be exposed. Hunt says several states, including Ohio, Indiana, West Virginia, and Kentucky are considering abortion bans similar to South Dakota’s.

A health official in the Netherlands has called for a debate on the idea of forced abortion and contraception to deal with what she sees as a crisis of unwanted children.

Alderman Marianne van den Anker of the Leefbaar Rotterdam Party wants specifically to target communities of Antilleans and Arubans where she sees the biggest problems of unwanted children.

Her comments have stirred protest by a health foundation working with those communities in Rotterdam. The group, which called the comments degrading, is asking Mayor Ivo Opstelten and other politicians to distance themselves from Van den Anker's views.

Van den Anker is a mother of two children and the official in charge of Rotterdam's health and security portfolios.

In an interview in a newspaper Saturday, she said she had tried everything to prevent child abuse.

"I fail, I fail," she told the interviewer as she outlined her controversial idea for a debate on compulsory abortion and contraception.

The target groups for her program are Antillean teenage mothers; drug addicts and people with mental handicaps, she said, according to a report in Expatica.

According to the report, Van den Anker said children from these groups run an "unacceptable risk" of growing up without love and with "violence, neglect, mistreatment and sexual abuse."

"The exceptions," she said, "and there are some, can be counted on a pair of hands."

Van den Anker pointed to the growing number of Antillean youth gangs in Rotterdam whose members come from loveless homes.


BTW, the primary racial makeup for the targeted population is black.

JACKSON, Miss. - Republican Gov. Haley Barbour said Wednesday that he likely would sign a bill to ban most abortions in Mississippi if it's approved by lawmakers.

The state already has some of the strictest abortion laws in the nation. The bill that passed the House Public Health Committee on Tuesday would allow abortion only to save the pregnant woman's life. It would make no exception in cases of rape or incest.

South Dakota lawmakers passed a similar bill last week that was intended to provoke a court showdown over the legality of abortion.

Responding to questions about whether he'd sign a bill with no exceptions for rape or incest, Barbour said: "It hasn't gotten to my desk yet. When one gets there, we'll find out, and I suspect I'll sign it. But I would certainly rather it come to my desk with an exception for rape and incest. I think that's consistent with the opinion of the vast majority of Mississippians and Americans."

The bill goes to the full House, which could vote next week. Speaker Billy McCoy, D-Rienzi, said he believes it will pass the House and move to the Senate.

McCoy told The Associated Press that although he opposes abortion, he always has been willing to make an exception for pregnancies caused by rape or incest.

"As I live longer and longer, the harder and harder it has become for me to accept abortion, period," McCoy said.

He said he'll listen to arguments on both sides of the issue. He said not allowing exceptions for rape or incest would be "pretty tough."

"It's also for those of us who don't believe in abortion to think about the taking of a human life, regardless of how it got started to be on this earth," McCoy said.

Lt. Gov. Amy Tuck, a Republican, said she hasn't had a chance to read the House proposal.

"I think this body will look very strongly on pro-life issues," said Tuck, who presides over the Senate.

The lawmaker who introduced the near-ban, House Public Health Committee Chairman Steve Holland said he acted because he was tired of piecemeal attempts to add new abortion restrictions each year.

Holland, D-Plantersville, said he has voted for some abortion restrictions and against others in the past.

Mississippi already requires a 24-hour waiting period and counseling for all abortions, plus the consent of both parents for minors who seek the procedure.

The state has one abortion clinic, in Jackson, and its leaders plan to fight if more restrictions are imposed.

Also, Nsombi Lambright, executive director of the American Civil Liberties in Mississippi, said her office had been contacted Wednesday by other abortion-rights groups that might sue Mississippi if the new restrictions become law.

"That's more of the state's legal resources going to something that didn't' have to happen," Lambright said.

Terri Herring, president of Pro-Life Mississippi, said she hopes the state will outlaw abortion, but she's not certain whether there's a majority on the U.S. Supreme Court willing to overturn Roe v. Wade, the 1973 Supreme Court ruling establishing the right to an abortion.

"We feel like we are still one justice short of being able to overturn Roe," Herring said.

The South Dakota legislation went to Republican Gov. Mike Rounds on Tuesday, and he has 15 days to act. Rounds has said he's inclined to sign the bill into law.

One thing I do believe contrary to some here might think is abortion should be a choice of the idividual.

now let me just go ahead and make this statement right quick...

many people who possess this mysteriously diminishing quality of common sense would lead you to believe that abortion is a non-issue... hell, perhaps when comparing all of the problems that we face as a nation, at home and abroad, this particular issue ranks at the bottom... but not me buddy, nosiree... abortion is my number one concern... right after gay marriage, brokeback mountain, and the farcical belief in diminishing family values... fuck all of the other real concerns that our nation faces each and every day... i say abortion is the tops! fuck yea!

That is my liberal side of me. you should have the right to say I wish to abort this and will have a child when we are ready both mentally and financially. -_-
