DURHAM, N.C. - A grand jury handed down a sealed indictment Monday against two Duke University lacrosse players related to allegations they raped a woman at a team party, NBC News’ Dan Abrams reported, citing two unnamed defense sources.

The charges against the two players are unclear, Abrams reported.

The grand jury adjourned for two weeks without issuing any public indictments.
A filing at the courthouse said the indictment was sealed by Superior Court Judge Ronald Stephens, who cited a state law that allows an indictment to be “kept secret until the defendant is arrested or appears before the court.”

Also unclear was whether the Duke case was among the 24 cases “carried forward” to be heard at a later date.

Bill Thomas, an attorney for one of the lacrosse team’s captains, was seen meeting with prosecutors at the Durham County Courthouse and said it was his understanding that the panel did consider the case.

Officers investigating the case were also among those at the courthouse, but because grand jury proceedings are secret it was not known if they testified.

A 27-year-old black woman told police she was attacked March 13 by three white men in a bathroom at a party held by the lacrosse team.

Attorneys for lacrosse team members had expected the panel to hear on Monday from District Attorney Mike Nifong, who for more than a month has been investigating the allegations made by the woman.

The next session of the grand jury is scheduled to be held in two weeks.

The racially charged allegations have led to near daily protest rallies. The school canceled the highly ranked team’s season and accepted the resignation of coach Mike Pressler after the release of a vulgar and graphic e-mail that was sent by a team member shortly after the alleged assault.

Defense attorneys have urged Nifong to drop the case, saying DNA tests failed to connect any of the 46 team members tested to the alleged victim.

Nifong has said 75 percent to 80 percent of rape prosecutions lack DNA evidence. According to court records, a medical examination of the woman found injuries consistent with rape.

Earlier, the exotic dancer identified two players with 100 percent certainty and a third at 90 percent as having raped her at a party last month, ABC News reported Monday, citing what Durham County prosecutors told the players' attorneys.

ABC News also obtained an audio recording in which a female security guard, who possibly was the first person to see the alleged victim, said she did not mention anything about a rape and that there were no signs that a sexual assault occurred.

"There ain't no way she was raped — ain't no way, no way that happened," the guard purportedly tells a private investigator in the recording, ABC News reported. The guard had called 911, after which police found the alleged victim at a grocery store parking lot, where the guard was working.

The tape was recorded April 3, three weeks after the alleged sexual assault, ABC News reported. On the tape, the guard says she called 911 after a driver of a car entered the grocery store and said that a woman — the alleged victim — refused to get out of her car.

The guard said the driver said she picked up the alleged victim, whom she had never met, after hearing people yell racial slurs at her as she was walking down the street, ABC News reported.

The guard further says on the tape that she smelled alcohol on the driver , but not the alleged victim, and that the alleged victim was unable to talk, ABC News said.

"That's the very first I've heard of that," said Bill Cotter, the attorney for indicted lacrosse player Collin Finnerty, who along with fellow Duke sophomore Reade Seligmann is charged with first-degree rape, kidnapping and sexual assault. He declined additional comment.

Attorney Joe Cheshire, who represents one of the uncharged players on the team, said he wants to know if prosecutors in the current case knew about the earlier allegation or if the accuser told them about it.

He added that he found it notable that authorities apparently declined to prosecute the earlier case.

"These are serious allegations, particularly for a person that age. In my mind, it would raise real issues about her credibility," he said.

Attorneys for Seligmann asked the court this week to order the state to turn over the accuser's medical, legal and education records and hold a pretrial hearing to "determine if the complaining witness is even credible enough to provide reliable testimony."

The accuser, a 27-year-old student at North Carolina Central University in Durham, told police she was hired to perform as an exotic dancer at a March 13 party, where she was sexually assaulted by three men.

According to the Creedmoor police report in August 1996, when the woman was 18, she told officers she was raped and beaten by three men "for a continual time" in 1993, when she was 14. She told police she was attacked at an "unspecified location" on a street in Creedmoor, a town 15 miles northeast of Durham.

The report lists the names of the three men, but no other details. Creedmoor police Chief Ted Pollard said Thursday he had no recollection of the report, and his staff has been unable to find any additional information about it.

Durham police officer Brian Bishop, who interviewed the accuser in 1996 while working on the Creedmoor force, said Thursday he had a vague recollection of the report but couldn't remember any details.

When asked about the accuser's previous report of rape, Durham County district attorney Mike Nifong declined to comment.

Before Seligmann and Finnerty were indicted, attorneys for the players pointed to the accuser's criminal history when answering questions about their clients' legal troubles. The woman pleaded guilty to several misdemeanors in 2002.[/quote]

Cheshire said Friday that the accuser now says she does not know if she was penetrated, which he said led District Attorney Mike Nifong to dismiss the rape charges.

The accuser, a 28-year-old student at North Carolina Central University, has said three men raped her in a bathroom at a March 13 team party where she was hired to perform as a stripper.

The players — Dave Evans, Collin Finnerty and Reade Seligmann — all say they are innocent. Their attorneys have consistently said no sex occurred at the party and have cited a lack of DNA evidence in the case as proof of their clients' innocence.

"It's highly coincidental," Cheshire said, that the charges are being dropped a week after the director of a private DNA testing lab acknowledged that he initially, with Nifong's knowledge, withheld from the defense test results showing none of the players' DNA was found on or in the accuser's body.

Testing also showed that genetic material from several males was found in her undergarments and body.[/quote]

im not in favor of lawsuits but these three guys should sue the fuck out of anyone they can in this case and this stupid bitch needs to be arrested.

Years ago a friend of mine picked up a girl at a bar and went back to her place, her husband(which he denies knowing that she was married) suppossedly was out of town but he wasn't and busted them, and she cried rape and he was arrested, he couldn't come up with the $500,000 bail money and ended up spending 8 months in jail going through his trial, during cross examination of the woman she admitted that she lied about the rape to cover up her cheating. He was released and they slapped her on the wrist

they ruined a top 5 lacrosse team who was most likely going to win the national championship and the coach quit because of all the bullshit. Duke and the players/coaches got completely screwed in this situation.
