Bengals RB Benson goes to trial on assault charges (served 5 days out of jail now)

Benson is facing allegations that he punched an Austin bar employee after he was escorted out in 2010 and could face up to a year in jail if convicted. He was arrested again last month on charges of fighting with a former roommate.

Benson has been the Bengals' leading rusher since 2008. He was an unrestricted free agent but chose to sign a one-year contract to stay with the team this season.

RB Cedric Benson has been excused from practices this week as he stands trial in Austin for assault in a May 2010 incident.
The trial was originally supposed to take place in June but was delayed at the request of Benson's lawyers when they received new evidence from prosecutors. Benson is accused of punching an employee at an Austin bar and could be sentenced to up to a year in jail if convicted.

Benson was also arrested last month for assault after an early morning incident in Austin involving an ex-roommate. That could put him under possible disciplinary action from NFL commissioner Roger Goodell, but Benson said last week that he had not received a letter from Goodell about meeting him in New York.

There are still varying accounts on if Goodell can suspend players for violations of the Personal Conduct Policy during a lockout. The common sentiment is that he will not discipline players unless it is for extremely egregious cases. Last week, Goodell had hearings with Kenny Britt and Aqib Talib. (and didn't suspend either one of them)

Agreement has been reached. Benson pleads no contest to assault. Agrees to 20-days in jail and $4,000 fine. He is now being thumbprinted

A [b]deferred sentence[/b] is a sentence that is suspended until after a defendant has completed a period of [url="http://en.wikipedia.org/wiki/Probation"][color="#0645ad"]probation[/color][/url]. If the defendant fulfills the stipulations surrounding probation, a judge may then throw out the sentence and guilty plea, clearing the incident from their record. If the defendant violates probation, he or she must serve the full sentence immediately

This incident happened May 2010. Benson was not suspened for it.

The fight with the roommate happened during the lockout.

Kenny Britt and Aqib Talib weren't suspended after meeting with Goodell.
They did a lot worse and/or were arrested multiple times.

I ain't worried about him being suspended.

Bengals running back Cedric Benson pleaded no contest in Austin, Texas, for assault in a 2010 incident involving an employee in an Austin bar. For the plea, Benson was sentenced to 20 days in jail.

Benson will return to Austin and turn himself in on Oct. 17, which is the day after the Indianapolis game at Paul Brown Stadium and the start of the bye week. Assistant Travis County Prosecuting Attorney Corby Holcomb told The Austin American-Statesman that with credit for good behavior, Benson would serve about a week in jail. If the normal schedule applies, Benson would only miss one or two practices and should be back in Cincinnati by Oct. 26, which would be the first major practice in preparation for the Oct. 30 game at Seattle.

“We are pleased that Mr. Benson took responsibility for his actions today,” Holcomb told The Statesman.

[color=#ff0000][b]Benson also resolved the assault charge from July 17 involving an incident with a former roommate. For that case, Benson has entered into a deferred prosecution agreement with prosecutors, which means the charge would be dismissed if he stays out of trouble for a year.He also agreed to serve 30 hours of community service and pay restitution to Clavens Charles. Holcomb told The Statesman that would be about $5,000.[/b][/color]

Last week Benson said he had not received a letter from Commissioner Roger Goodell about a hearing in New York for possible violations of the personal conduct policy. If things go like they have in other lockout-related offenses, Benson should not be suspended by the league.
